REST is not responsible for any damages, losses, or other liabilities that arise from the services provided by Service Providers.

IN NO EVENT WILL REST OR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

Taxes – You are responsible for determining and paying any applicable taxes, including sales tax, occupancy tax, or other similar taxes, that may apply to the services provided by Service Providers through our platform.

Cancellations, Travel Issues, and Booking Modifications – You understand and acknowledge that REST is not responsible for any cancellations, travel issues, or booking modifications related to the services provided by Service Providers. It is your responsibility to communicate with the Service Providers and to make any necessary changes to your booking.

Reviews – REST may allow you to leave reviews of Service Providers. You agree to provide honest and accurate reviews and to comply with our content guidelines. REST reserves the right to remove or edit any reviews that violate our guidelines or these Terms.

Resolving Complaints – If you have any complaints related to the services provided by Service Providers, please contact us immediately. We will make reasonable efforts to resolve the issue.

REST’s Role – You understand and acknowledge that REST is not a provider of the services offered by Service Providers. REST is not responsible for the conduct of Service Providers or any other users of our Services. REST is not liable for any damages, losses, or other liabilities that arise from the services provided by Service Providers.

Limitations and Liability – IN NO EVENT WILL REST OR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICES, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF REST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnifications – You agree to indemnify and hold REST and its affiliates, officers, employees, agents, and licensors harmless from any claims, demands, damages, or other liabilities, including reasonable attorneys’ fees, arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of another.

United States Governing Law and Venue – These Terms shall be governed by and construed in accordance with the laws of the United States, without giving effect to any principles of conflicts of law. Any action arising out of or related to these Terms shall be brought exclusively in the federal or state courts located in the United States.

United States Dispute Resolution and Arbitration Agreement -0 You and REST agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof or the use of the Services (collectively, “Disputes”) will be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

The arbitration will be administered by the American Arbitration Association (“AAA”)
